1. Heard learned counsel for the applicant, learned AGA for the State- respondents and perused the record. 2. This bail application has been moved on behalf of accused-applicant Jeetu Kushwaha seeking enlargement on bail in Case Crime No.27 of 2025, under Sections 309(6), 317(2) B.N.S., Police Station Premnagar, District Jhansi. 3. Learned counsel for the applicant submits that the accused-applicant has not committed any offence as alleged in the FIR and has been falsely implicated in this case. Applicant is languishing in jail since 3.2.2025. It is submitted that initially the FIR was registered as unknown but during the course of investigation name of applicant was surfaced on the basis of information given by the I.O. It is further submitted that motorcycle bearing registration no. UP93BP0838 and some ornaments were said to be recovered from the possession of the applicant but neither any independent and reliable witness was present on spot at the time of preparation of recovery memo and arrest nor there is any specification/detail of the ornaments in the FIR. It is argued that applicant has 10 criminal history which has been explained in para 11 of the bail application. Submission is that the conclusion of trial will take sufficiently long and there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. 4. Learned AGA has vehemently opposed the prayer for grant of bail but could not dispute the aforesaid submission.
