Heard Mr. D. Medhi, learned counsel appearing for the petitioners. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor appearing for the state respondent.
2. This application has been filed under Section 483 of the BNSS, 2023 seeking regular bail by the petitioners, namely, (1) Musful Begum, (2) Rahima Begum and (3) Rahim Ali in connection with Hatigaon P.S. Case No. 160/2025 registered under Sections 21(b)/29 of the NDPS Act.
3. The petitioners are stated to be all family members. The allegation made in the FIR dated 28.08.2025 is about recovery of grams of suspected heroin from Rahima Begum. Subsequently in her statement recorded under Section 67 of the NDPS Act she stated about recovery of another 8 grams of heroin from Rahim Ali and Musful Begum.
4. The case diary has been received.
5. Mr. P. Borthakur, learned Additional P.P. submits that the investigation lends support to the allegations made in the FIR stating that petitioners are illegally engaged in peddling activity of narcotic drugs. It is submitted that with regard to Rahim Ali another case is pending under the NDPS Act before the Court of the learned Sessions Spl. Judge, Kamrup (Metro), Assam. The investigation is stated to be pending for the FSL report and other part of the investigation appears to be over.
6. Under the given situation, I allow the petitioners, namely, (1) Musful
Page No.# 3/3 Begum, (2) Rahima Begum and (3) Rahim Ali to go on bail of ₹50,000/- each with a surety of the like amount each to the satisfaction of the learned Special Judge, Kamrup (Metro), Assam subject to the following suitable conditions :- (i) The petitioners shall be available for trial, if one commences; (ii) They shall not tamper or hamper with the evidence or try to influence witnesses; (iii) The petitioners shall not indulge in peddling activity of narcotic drugs; Violation or breach of any condition(s) shall entail cancellation of bail.
7. With the aforesaid direction, the bail application is allowed and stands
disposed of.
