HIGH COURT OF JUDICATURE AT ALLAHABAD CONTEMPT APPLICATION (CIVIL) No. - 3811 of 2025 Court No. - 37 HON'BLE DINESH PATHAK, J.
1. Opposite party has filed the discharge application supported by compliance affidavit, today in the Court, which is taken on record. Office is directed to proceed accordingly.
2. Learned Standing Counsel representing opposite party states that claim of the present applicant for arrears of salary has been considered by the opposite party and the same is negated by the order dated 10.10.2025 (page nos.15 to 19 of the compliance affidavit).
3. Learned counsel for the applicant has tried to challenge the legality and correctness of the order dated 10.10.2025 passed by the opposite party and submits that the order dated 21.01.2025 has not been complied with in its true letter and spirit, and arrears has not been paid to the present applicant.
4. Having considered the rival submissions advanced by learned counsel for the parties and upon perusal of record, it manifests that opposite party was directed to pay the arrears of salary, if there is no legal impediment. Relevant paragraph no.4 of the order dated 21.01.2025 is quoted herein below :-
"In aforesaid circumstances, without issuing notice to respondent-5 since it appears that claim of petitioner has already been forwarded by the D.I.O.S. and order of single operation was passed on 28.10.2023, therefore, this writ petition is disposed of with an observation that arrears of salary be paid to petitioner within a short period as already an order of single operation has been passed, if there is no legal Versus Counsel for Applicant(s) : Ratnakar Upadhyay Counsel for Opposite Party(s) :
Rananjay Singh .....Applicant(s) Rakesh Kumar District Inspector Of Schools .....Opposite Party(s)
impediment."
5. In my considered opinion, upon considering the legal impediment in the matter of paying arrears of salary to the present applicant, opposite party has passed a detailed order dated 10.10.2025 and negated his claim. Present applicant, in case, is aggrieved with the order dated 10.10.2025, he can resort to alternative remedy to challenge the said order before the Court competent.
6. In this conspectus, as above, instant contempt application is dismissed. October 15, 2025 VR CAPL No. 3811 of 2025 2 (Dinesh Pathak,J.) Digitally signed by :- VIBHA RATAN High Court of Judicature at Allahabad
