The present intra-court appeal is directed against order of learned Single Judge dated 29.08.2025 in Writ-A No.12713 of 2025 filed by the non-appellant (petitioner in the writ petition). The learned Single Judge has maintained the punishment awarded to the petitioner in relation to withholding of one increment in time scale of pay without cumulative effect upto date of retirement but has set aside cash penalty of Rs.50,000/- . 2. Shri Sachin Mishra, learned counsel for the appellant submits that the punishment awarded to the petitioner was reduction of one increment in time scale of pay without cumulative effect but in paragraph-3 of the order under challenge, the learned Single Judge has mentioned that the punishment was reduction of one increment with cumulative effect. 3. Counsel for the respondent/petitioner readily accepts that the punishment awarded to the petitioner is reduction of one increment in time scale of pay without cumulative effect apart from cash penalty which part alone has been set aside by the learned Single Judge. Counsel for the respondent/petitioner has, thus, no objection in case, necessary clarification is made by this Court in respect of the narration of facts in paragraph-3 of the order of learned Single Judge. 4. Having regard to the above aspects, we dispose of the instant appeal by clarifying that the petitioner was awarded punishment of reduction of one Versus Counsel for Appellant(s) : Sachin Mishra Counsel for Respondent(s) : Sunil Kumar Dubey Board Of Directors, Prathma U. P. Gramin Bank Now Uttar Pradesh Gramin Bank And 2 Others .....Appellant(s) Kishan Swaroop .....Respondent(s) increment in time scale of pay without cumulative effect.
