Ajay Mohan Goel, Judge (Oral) By way of this writ petitioner, the petitioner has inter alia prayed for the following reliefs:- i. That the respondents No. 1 and 2 may kindly be directed to take joining of the petitioner for the post of driver as per the selection letter Annexure P-3. 2. The grievance of the petitioner is that after offer of appointment was made to him against the post of Driver, on contract basis, in terms of Annexure P-3, dated 14.10.2019, he was not 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:1273 allowed to join on account of pendency of a criminal trial against him. Learned Counsel for the petitioner submits that during the pendency of this writ petition, the criminal trial has resulted in the acquittal of the petitioner as far back as in the year 2022, yet, the appointment has not been offered to the petitioner. 3. Mr. Ajay Chauhan, learned Counsel for respondents No. 1 and 2 submits that he has instructions to state that Corporation is ready to offer appointment to the petitioner but the same will be prospective. 4. Learned Counsel for the petitioner under instructions submits that the petitioner is ready and willing to accept the appointment prospectively. 5. In the light of said fact situation, this writ petition is disposed of with direction that appointment be offered to the petitioner against the post of Driver under the quota of ex servicemen prospectively, however, subject to his freshly passing the driving test as well as medical test. Needful to ascertain the driving skills of the petitioner as well as his medical condition be done within a period of three weeks and in case, the petitioner is found good enough to man the post, then he be offered appointment against the post of Driver prospectively, forthwith. 3 2025:HHC:1273 The writ petition stands disposed of in above terms, so also pending miscellaneous application(s), if any.
