(Civil) No. 3812/2024, whereby the delay in filing has been condoned, the present application has been taken up for recalling the order dated 02.05.2024. The learned Senior Counsel appearing for the petitioner submits that the advocate on record was not reflected on the cause list and consequently the concerned Advocate on record failed to appear in the Court or inform or engaged Mr. Sarmah to appear in the matter consequently this matter stood dismissed for non prosecution. Taking note of the submissions made and the grounds urged, this Court is of the view that the petitioner/applicant has been able to explain the grounds for non appearance before the Court on the date when the matter was called up and was ultimately dismissed for non prosecution. No objection is also raised by the respondents in respect of the prayer made accordingly, M.C. No. 85 of 2024 stands allowed. The order dated 02.05.2024 passed in WP(C) No. 2421 of 2013 is recalled and the writ petition is restored to file. Registry to list the writ petition after two weeks.
