Sri Aftab Ahamad, learned counsel for the applicant, Shri Alok Mishra, learned A.G.A. for the State and perused the material on record. The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed to quash the order dated 22.7.2025 passed by Additional Sessions Judge, Court No. 1, Mirzapur in Criminal Revision No. 255 of 2023, whereby the revisional court affirmed the order dated 9.10.2023 passed by Additional Civil Judge (Junior Division), Court No. 4, Mirzapur, whereby an application under Section 156(3), Cr.P.C. has been dismissed. Learned counsel for the applicant fairly admits that this is not a matter related to serious offence. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Office shall return the certified copy of the orders to the learned counsel for the applicant, after retaining a xerox of the same. October 15, 2025 T.
