2025:JHHC:21516 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.BA.No. 3996 of 2025 ----- Poonam Singh @ Jhamki Ji, aged about 62 yrs, w/o Dinesh Kumar Singh, r/o 62, Roba Colony, Near Sitla Mandir, PO Marar, PS Ramgarh, Dist. Ramgarh … Petitioner(s). Versus State of Jharkhand … Opp. Party(s). CORAM :SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. A.K. Chaturvedy, Advocate For the State : Mr. Manoj Kr. Mishra, APP …...... 02 /01.08.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Mandu (Kujju) PS case no. 154 of 2024 registered for the offences punishable under sections 306/34 of the IPC, pending in the court of learned Additional Chief Judicial Magistrate, Ramgarh. 2. Heard the learned counsel for the petitioner, learned counsel appearing on behalf of the State. 3. The learned APP opposes the prayer for anticipatory bail of the petitioner. 4. Allegation in the FIR is that the husband of the informant had gone to his shop and thereafter the informant received no communication from him. The informant went to the shop and found that the deceased had committed suicide and suicidal note was found in which it was written that some persons were threatening him and demanding money. Thus he had committed suicide. 5. From the records of this case and after hearing the parties, I find from para-11 of the case diary that this petitioner had given Rs.1,00,000/- to the deceased as loan on interest and when this petitioner was demanding the same, he committed suicide. Further there is evidences that from the other persons also deceased had taken money and also not returned. 2025:JHHC:21516 6. From the aforesaid fact without commenting any further in the case, I am of the opinion that this is a fit case for grant of anticipatory bail, as there is no prima facie material to suggest involvement of the petitioner. 7. Considering the aforesaid facts, I am inclined to release the petitioner on anticipatory bail. Accordingly, the petitioner, above named, are directed to surrender before the court below within four weeks from today and in the event of her surrender/arrest the learned court below is directed to enlarge her on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Ramgarh, in connection with Mandu(Kujju) PS case no. 154 of 2024, subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/ her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his /her share in the property.
