This is an application under Section 483 of the BNSS, 2023 whereby the petitioner, namely- Sri Amorjyoti Deka @ Babul Deka has prayed for releasing him on bail after he was arrested in connection with Ghilamara P.S. Case No.30/2025, under Sections 329(3)/305 of BNS, r/w Section 11(1)(a) of Prevention of Cruelty to Animal Act. 3. The allegation brought against the present petitioner is that he had stolen a cow. Now, he has been in custody for the last 40 (forty) days. 4. Mr. Parasar has pointed out that the petitioner is a regular criminal committing similar offence on earlier occasions. Mr. Parasar further pointed out that in such a case, he has already been charge sheeted. 5. I have considered the submissions made by the learned counsel of both sides. 6. Considering the long period of detention, the bail application of the petitioner is allowed. 7. Accordingly, the petitioner, namely- Sri Amorjyoti Deka @ Babul Deka who was arrested in connection with Ghilamara P.S. Case No.30/2025, under Sections 329(3)/305 of BNS, r/w Section 11(1)(a) of Prevention of Cruelty to Animal Act, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (M), Dhakuakhana. With the above direction, the present bail application is disposed of. JUDGE Comparing Assistant
