The petitioner js arrayed as accused No.4 in Cr['me No.109 of 2025 of Nandyal police Station, Nandyal District for the offences registered under section 308(5) I/w. 3(5) BNS. 2.I The petitioner prays for a direction to release him on Bal'l, in the event of arrest. 3. Heard both sides. 4. Point for determination: whether the petitioner/accused No.4 is ent-ltled for grant of pre-arrest bail in terms of Section 482 of BNSS? lf so, on what terms? Point: 5. The case of the prosecution, jn brief, I-s that the I-nfOrmant/Jayaraju Addakula on 08.05.2025 at about o5.-00 p.m., along with one Bangi Sankar, when eating GobI' at Dumping yard near p.v. Nagar, Nandyal Mandall the PetI-tiOner, along with other accused, approached them and one of the accused asked for a matchbox. Later, accused persons forcibly extorted the oppo Reno ST 5G mobile phone from the informant's friend Bangi Sankar. Accused No.3 slapped the complainant and beat him with his legs. Accused No.1 showed them a knife / <...i-i_~.y.` ` -_T and asked them for money. Thereafter, they threatened and extracted the money by demanding to transfer the same through PhonePe in the name of accused No.1. Further, the victims are intimidated, hurling threats that if the information is sent to anybody, they will be killed. During the attack, some dumb injuries are also caused to victims. 6. The petitioner / accused No.4 denied all the allegations. 7. Learned counsel for the petitioner submitted that the petitioner/accused No.4 is innocent. The case is foisted with' false allegations. Except the confession of co-accused, there is no other material to tag the petitioner. 8. Learned counsel for the petitioner further submitted that the Petitioner has recently completed the intermediate examination and also appearing for pursuing Engineering education etc. 9. Learned Assistant Public Prosecutor submitted that four witnesses were examined and the investigation is pending. He has formally opposed the application. 10. Learned counsel for the petitioner submitted that the petitioner is aged I about t19j years and having bright future.
