On hearing the learned counsel for both the parties and the documents filed along with the supplementary affidavit, it appears that the petitioner herein has been provided with a KMC Assessee No.110751200456 in respect of the premises in this case. 2. Learned counsel for the KMC submits that at page 8 is a document of the KMC Assessment & Collection Department which shows that the owner is the Collector, 24 Parganas. 3. It appears from the said document that the mailing address therein is of one Sri Harihar Roy who is the predecessor of the petitioner herein. As such though owner information is given as Collector, the name of Harihar Roy is shown as the mailing address. The claim of the petitioner is that they are the assessee in respect of the property and in spite of paying all 2 the tax as required the name is not being mutated in the Corporation record. 4. It further appears that the petitioner has filed her representation before the Corporation but the same has not been considered by the respondents till date. 5. Learned counsel appearing for the Corporation submits that, no such representation has been filed with the Corporation. The contention is substantiated with the fact that there is no copy of the representation annexed with the writ petition. 6. The petitioner has now annexed a copy of the representation dated 1st April, 2015 to the supplementary affidavit filed. 7. Considering such submission of the learned counsels for both side and the Corporation, the writ petition is disposed of with the direction that the respondent/KMC shall consider the application dated 1st April, 2015 filed by the petitioner within 60 days from the date of this order, on hearing all the stake holders and pass a reasoned order in accordance with law. The KMC shall also consider as to why an Assessee number in respect of the petitioner has been given and the petitioner being also shown as mailing address in respect of the property concerned, though the Collector is shown 3 and recorded as the owner. 8. The writ petition stands disposed of. 9. Pending applications stand disposed of. 10. Interim order, if any, stands vacated 11. Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities.
