The instant appeal was filed under Order 43 Rule-1(r) of the CPC by the plaintiff in O.S. No.255 of 2025 (Rudra Shiva Vs. Jagdish Nauhvar and another) against the impugned order dated 21.08.2025 passed by Additional Civil Judge (Senior Division), Court No.2, Mathura, whereby the plaintiff's 7C application under Order 39 Rule 1 and 2 CPC was rejected on merits. 2. Learned counsel for the plaintiff-appellant submits that a compromise has been reached between the parties. As such, he wants to withdraw this appeal. 3. In view of the above, the plaintiff-appellant is permitted to withdraw the instant appeal. 4. Accordingly, the instant appeal is dismissed as withdrawn. 5.
