Respondent(s) For Petitioner : Mr. Ajay Pal Singh, Advocate For Respondent : Mr. Sunil Pillai, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 07-07-2025 1) At the very outset, Mr. Pillai submits that the impugned order issued under Section 7-A of EPF and MP Act, 1952 is appealable according to the provisions of Section 7-I of the Act, 1952 before the learned Central Government Industrial Tribunal (CGIT), Jabalpur. 2) At this stage, Mr. Singh seeks permission of this Court to withdraw this petition with liberty to avail the remedy available under law. Digitally signed by AJINKYA PANSARE Date: 2025.07.07 17:07:09 +0530 2 However, he submits that learned Tribunal may be directed to consider the issue of limitation taking lenient view as the matter remained pending before this Court for considerable period. 3) No objection from other side. 4) Taking into consideration the fact that there is statutory alternative remedy available to petitioner to prefer appeal before CGIT, Jabalpur, I am not inclined to keep this matter pending. Consequently, this petition stands dismissed as withdrawn reserving liberty in favor of petitioner to prefer a duly constituted appeal within period of 30 days from today. 5) The appellate authority is directed to decide the appeal, if so preferred by petitioner expeditiously, strictly in accordance with law.
