This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“...pleased to issue a writ, direction, order or orders more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent No.3, harassing the petitioner, calling the petitioner and his family members to the police station and sending the Police Constable to the petitioners house regularly and abusing with filthy language with the petitioners family members is bad, illegal and unlawful, discriminatory, contrary and violation of principle of natural justice and to direct the Respondent No.3 not to interfere with the life and liberty of the petitioner and to pass..”

When the matter is taken up for consideration, the learned Assistant Government Pleader for Home, on written instructions, submitted that one Bathula Naga Deepthi, 5th respondent herein lodged a complaint on respondent No.5 in Cr.No.573/2020 for the offence punishable under Section 498 (A) IPC and Section 3 & 4 of D.P Act of Penamlur Police Station, Vijayawada. During the course of investigation, it was revealed that, the petitioner, N.Ramesh, got acquainted with respondent No.4 and allegedly threatened her to give divorce to her husband and marry him. As the petitioner was involved in Cr.No.573 of 2020, the police attempted to serve notice under Section 41-A Cr.P.C. Since the petitioner was not available the same could not be effected. Except that, the police have never called the petitioner to the police station nor harassed him by visiting his house. 4
3. Sri K.V.Aditya Chowdary, learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 4. Recording the same, the Writ Petition is disposed of. However, the Police are directed to follow the due process of law in connection with the investigation of Cr.No.573 of 2020. No order as to costs.
