ORDER:
1. This is an application filed under Section 482 of Bharatiya Nagarik suraksha sanhita, 2023 for grant of pre-arrest bail. The petitioner is arrayed as accused No.5 in Crime No.17 of 2025 of Atmakur Police Station, Ananthapuram District, with the allegations of committing the offences under Sections 118(1), 115(2) r/w 3(5) BNS.
2. The petitioner prays fora direction to release him On Bail, in the event of ar-rest.
3. Heard both sides.
4. Point for determination: Whether the petitioner/accused No.5 is entitled for grant of pre-arrest bail in terms of Section 482 of BNSS? lf so, on what terms? Point:
5. The case of the prosecution, in brief, is that there are disputes between the family of the informant i.e. B. Nagalakshmi and the accused family in connection with the lands. On 04.03.2025, when the land survey was taking place, all the accused came to the land of the complainant and accused Nos.1 to 3 beat the complainant with sticks. Later, accused Nos.4 to.6 kicked the complainant with legs and the complainant sustained dumb injuries. _ ,|s~t'g \'t->
The petitioner / accused No.5 denied all the allegations.
Learned counsel for the petitioner submitted that in respect of accused Nos.1 to 4 and 6, pre-arrest bail has already granted. There is civil dispute between the parties covered v,'de o.s.No.1319 of 2022 on the file of learned principal Junior Civil Judge, Dharmavaram. The present criminal prosecution is an abuse of the process of law. However, the petitioner is ready to abide by conditions and he will be available for trial etc. purposes. 8. Learned AssI-Slant Public Prosecutor submitted that five witnesses were examined and he has formally opposed the application. 9. Upon considering the facts and circumstances of the case, the nature and depth of allegations, the prayer for grant of pre-arrest bail found convincing. 10. In the result, the criminal Petition is allowed, on the following conditions: 1 ) Petitioner shall be released on bail in the event of hI-S arrest in respect Of Crime No.17 of 2025 of Atmakur Police Station, Ananthapuram District, which was registered with the allegation of committing offences under sections 118(1), 115(2) r/vy 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the condition of Petitioner/Accused No.5 executing bail bonds for Rs.20,000/-with two sureties each for a like sum to the satisfaction of the s.H.O., Atmakur Police Station, Ananthapuram District. 2) The Petitioner/Accused No.5 and-his sureties shall furnish their Permanent residential address details and identity Particulars tO the COnCerned *<:? r` -.-_> _,_i=ha
