HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 11741 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J. Heard learned counsel for petitioner and learned State Counsel for opposite parties. Petition has been filed challenging order dated 19.02.2024 whereby petitioner has been placed under suspension in contemplation of enquiry proceedings.
Learned counsel for petitioner submits that subsequently by means of
order dated 09.10.2025, petitioner has been reinstated in service thereby deeming impugned suspension order having been revoked, although no specific indication has been made in order regarding its revocation. Learned State Counsel has been provided written instructions dated 11.10.2025, which are taken on record and also submits the same. Upon perusal of order dated 09.10.2025, it is evident that petitioner has been reinstated in service without any adverse affect to the on-going enquiry proceedings. Although order does not indicate revocation of suspension order dated 19.02.2024, in the opinion of this Court, reinstatement of petitioner would have deeming effect of revocation of impugned suspension order dated 19.02.2024. Since order indicates that aspect of service benefits pertaining to suspension period would be considered by a separate order, opposite party Versus Counsel for Petitioner(s) : Suyash Tripathi, Amrendra Nath Tripathi Counsel for Respondent(s) : C.S.C. Ajay Kumar Baliyan (Pno-172540146) .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Lko. And 2 Others .....Respondent(s)
