The petitioner has been made accused in connection with POCSO Case No. 37 of 2019 arising out of Sisai P.S. Case No. 77 of 2019, for the offences registered under Section 376 D.A. of the I.P.C. and under Section 4/8 of the POCSO Act, pending in the Court of learned Additional Sessions Judge-IV-cum- Special Judge, POCSO, Gumla. 3. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No. 4582 of 2024 by order dated 22.01.2025. 4. It is alleged that petitioner alongwith co-accused persons had gang-raped the victim. 5. It was submitted that the petitioner is in custody since 27.06.2019. It was further submitted that on the last occasion, while hearing the Bail Application of the petitioner, report was called for from the learned Trial Court regarding the stage of trial and it was reported that two witnesses remain to be examined in this case. It was submitted that the trial has not progressed and the prosecution is yet to examine these two witnesses. 6. Considering the period of custody, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge- IV-cum-Special Judge, POCSO, Gumla in connection with POCSO Case No. 37 of 2019 arising out of Sisai P.S.
