lN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATl (special Original Jurisdiction) PRESENT THE HONOURABLE SRI JUSTICE T IVIALLIKARJUNA RAO CRIMINAL PET[T]ON NO: 5797/2025 Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioner/A4, seeking regular bail, in crime No.148 of 2025 of Mangalagiri Rural Police Station, Guntur. 2. A case has been registered against the Petitioner/A4 here'ln and others for the offences punishable under Sections 20(b)(ii)(B) r/w 8 (c) of the Narcotic Drugs and Psychotropic substances Act,1985 (for short {the NDPS Act'). 3. The brief facts Of the Case are that this 'lS the Case Of illegal possession and selling of ganja and MDMA. Al to A4 are addicted to ganja and other bad habits. Al who made friendSh-IP with A6 and purchased MDMA packets from A6 @ Rs.5,000/- per one gram and in turn sell A2 for higher price. Further Al and A2 purchases ganja from A5 for Rs.8,000/-per kg and in turn Al to A4 consumes some Of ganja and Al and A2 makes smaller -| '-i``
2 packets of 20 grams and gives them to A3, A4 to sell i{ for higher rates of Rs.1,000/-each packet.
On Ramzan festival day A6 came to Vijayawada Al purchased 10 grams of MDMA from A6 and sold two packets to A2 and kept on packet with A1 . Then A2 brought 1.2 kgs of ganja and made four packets and called A3 and A4 to delight dhaba and Al to A4 all met there, A2 gave ganja packets to each of them and consumed some ganja, then police raid and caught hold Al to A4 and seized 1.2 kgs of ganja and one packet of MDMA weighing about 5.980 grams from Al and two packets of MDMA from A2 weighting about 1.980, 0.750 grams, total 8.81 grams of MDMA and also seized KTM Bike of A2 under the cover of mediatOranam. 4. Heard. Perused the record. 5. Learned counsel for the petitioner submits that the petitioner has been in judicial custody from 04.04.2025 and the contraband said to be involved in this case will not come under the purview of the commercial quantity. The learned Assistant Public Prosecutor did not dispute the said fact. When ascertained the learned Assistant Public Prosecutor confirmed that the petitioner has no antecedents. As the contraband seized is not of commercial quantity, no reasons need to be recorded +
+ 3 as contemplated under Section 37 of the NDPS Act. Most of the witnesses are shown to be official witnesses and the release of the accused would not cause hampering of investigation. As most of the investigation might have been completed, as such, this Court is inclined to grant bail to the petitioner with the following conditions: (i) The petitioner/A4 shall be released on executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with one surety for a like sum each to the satisfaction of the learned Additional Judicial Magistrate of First class-Cum-Civil Judge (Junior Division) Court, Mangalagiri.
(ii) After release, the petitioner shall appear before the Station House Offl'cer concerned, once in a fortnight for a period of three (03) months.
