HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 11785 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J. Heard learned Counsel for petitioner and Mr.S.B. Pandey, learned Deputy Solicitor General of India assisted by Mr.Varun Pandey, learned counsel for opposite parties. Petition has been filed challenging order dated 16.09.2025 whereby petitioner's application for 10 days' Special Leave has been rejected. Learned counsel for opposite parties at the very outset has raised a preliminary objection regarding maintainability of this petition before this Court since the authority concerned has passed order in Shrikaranpur, Rajasthan. In response thereto, learned counsel for petitioner submits that petition has been filed at Lucknow since he is resident of Amethi which falls within the territorial jurisdiction of this Court. Considering preliminary objection raised and upon examination of prayer made, it is evident that order has been challenged which has been passed by authority situate in Rajasthan. Petitioner is still in service and learned counsel for petitioner has not been able to demonstrate as to how even part of cause of action has been accrued to petitioner merely on his being resident of Amethi which falls within territorial jurisdiction of this Court. In view of the aforesaid facts and circumstances of this case, this Court does not have any authority/jurisdiction over the issue in question. Petition is dismissed granting liberty to petitioner to agitate his cause before the appropriate forum.
