HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW SPECIAL APPEAL No. - 352 of 2025 Court No. - 1 HON'BLE RAJAN ROY, J.
HON'BLE RAJEEV BHARTI, J.
1. Heard.
2. This is an appeal challenging the judgment and order dated 10.09.2025, passed by Writ -A No.10513 of 2025 by which the writ petition filed by the appellant challenging his transfer order dated 14.08.2025 has been dismissed.
3. The appellant who is Assistant Sub-Inspector of Police was transferred from Unnao to Varanasi by the order dated 14.08.2025, issued by the Additional Superintendent of Police, Establishment on behalf of Deputy Inspector General of Police Personnel/Karmik, U.P. Lucknow from the D.G. Police Headquarter, U.P. at Lucknow.
4. The contention of the appellant's counsel is that the transfer is in violation of the circular of the D.G., Police, U.P. dated 10.03.2025 as also another circular dated 22.06.2017 wherein the administrative grounds on which transfer can be made has been defined. We are not impressed by this argument. The transfer of the appellant is in public interest. Versus Counsel for Appellant(s) : Ganga Prasad Mishra, Abhinav Mishra, Satya Prakash Counsel for Respondent(s) : C.S.C. Avanish Kumar, Pno 952431033 .....Appellant(s) State Of U.P. Thru. Addl. Chief Secy. Deptt. Home Lko. And 2 Others .....Respondent(s)
5. During course of argument, counsel for the appellant sought to impress upon us the fact that normally transfers are made by June of the year, but in this case he was transferred in August, 2025. However, this by itself does not prejudice the appellant especially as his children are studying for graduation and on being asked as to where they are studying, he could not inform us.
6. Having gone through the judgment impugned before us, we do not find any error therein nor any ground for interference in the said judgment or the transfer order, impugned before it.
7. The special appeal is, accordingly, dismissed. October 13, 2025 Anand/- SPLA No. 352 of 2025 2 (Rajeev Bharti,J.) (Rajan Roy,J.) Digitally signed by :- ANAND KUMAR SRIVASTAVA High Court of Judicature at Allahabad, Lucknow Bench
