Learned counsel appearing for the petitioner would submit that the petitioner was selected against the post of Assistant Teacher (Science) pursuant to Advertisement issued in the year 2019. He would contend that the candidature of the petitioner was rejected on the ground that the validity of her TET certificate got expired as it was acquired in the month of February, 2012. He would submit that subsequently notifications were issued by the National Council for Teachers Education (NCTE) on 09.06.2021 wherein it is stated that the validity period of TET qualifying certificate for appointment, unless otherwise notified by the appropriate government, would remain valid for life. He would contend that the claim of the petitioner should have been considered by the respondent authorities. 3. On the other hand, learned Deputy Government Advocate appearing for the State/respondents would submit the District Education Officer has sought directions/instructions from respondent No. 2 vide letter dated 30.06.2022 and same is still awaited. 4. Heard learned counsel for the parties. 5. Considering the submissions made by respective Advocates, this petition, at this juncture, is disposed of reserving liberty in favour of the petitioner to make a representation before respondent No. 2 pursuant to notification issued by NCTE dated 09.06.2021 and letter issued by the District Education Officer, Durg addressed to respondent No. 2 dated 30.06.2022 within a period of 10 days and in turn, the authority 3 concerned is directed to consider the claim of the petitioner strictly in accordance with law in the light of aforestated notification and letter preferably within a period of 90 days from the date of receipt of copy of this order. 6.
