HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 9803 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J. Heard Shri Durgesh Mishra, Learned Counsel for the Petitioners, and Shri Pankaj Srivastava, Learned Additional Chief Standing Counsel, for the State of U.P. The instant writ petition has been filed by five petitioners, seeking issuance of a writ of Mandamus, commanding the opposite parties, particularly the Opposite Party No. 2, U.P. Sanskrit Shiksha Parishad, to re-evaluate the answer books of 21 students of Ram Saran Yadav Sanskrit Madhyamik Vidyalaya, Redigarapur, Patti, Pratapgarh. The court put the following precise questions to the Learned Counsel for the petitioners: 1. Whether a writ petition seeking re-evaluation of answer books of 21 students can be filed by five petitioners? 2. Whether there is any provision under which the petitioners are entitled to seek re-evaluation of answer books of class X (Purva Madhyama Second)? 3. And, whether, in the absence of existence of any legal enforceable right and infringement thereof, a writ petition seeking issuance of a writ of Mandamus would be maintainable? To the aforementioned categorical questions put by the Court to the Learned Counsel for the petitioners, he replied that the court should pass Versus Counsel for Petitioner(s) : Durgesh Mishra, Manvendra Mishra Counsel for Respondent(s) : C.S.C. Achal Kumar Yadav And 4 Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Madhyamik Education U.P. Lko. And 2 Others .....Respondent(s) appropriate orders considering the entire facts of the case. As the Learned Counsel for the petitioners has failed to advance any submission, and as there is no material from which it can be established that any legal enforceable right of the petitioners has been infringed, this writ petition seeking issuance of a writ of Mandamus is not maintainable and it is dismissed accordingly.
