Learned counsel appearing for the petitioner submits that the petitioner is in no way involved with the alleged offence. She has only joined the protests against the death of an intern at the R.G. Kar Hospital. She is being politically victimised.
Learned counsel for the State relies on the case diary and submits that a prima facie case is made out against the petitioner. She has been found to make certain drawings and give slogans against the State. Apart from other things, she was seeking armed revolution. It will be for Courts to finally decide whether the offences alleged are made out or not or the petitioner had transgressed all limits of freedom of speech.
2 However, as there is nothing against the petitioner at the present except the allegation that she made certain drawings and gave some slogans, I do not think that custodial interrogation of the present petitioner is required in this case. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further condition that the petitioner shall cooperate with the investigation.
The application for anticipatory bail is, thus, allowed.
