ORDER:
1. This is an application filed under Section 482 of the Bharatiya Nagarik suraksha sanhita, 2023, for grant of pre-arrest bail. The petitioners are arrayed as accused Nos.1 and 2 in Cr.No.184/2025 of Duvvada Police station, visakhapatnam commissionerate, which was registered with the allegation of committing the OffenCeS under Sections 85] 308(5),137(2),108 r/w 62 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 3 and 4 of the Dowry Prohibit'lon Act, 1961. 2. The petitioners pray for directions tO release On Bail, in the event Of arrest. 3. Heard both sides. 4, Point for determination: (i) whether the petit|loners/accused Nos. 1 and 2 are entitled for grant Of pre-arrest bail in terms of section 482 of BNSS? If so, on what terms? 5. The case of the prosecution in brief 'lS that informant -K.Rajeshwari is the wife of petitioner/Accused No.1. The-lr marriage was Performed On o8.05.2017 and they are blessed with two Children. After marriage petitioner/Accused No.1 res'lgned the job and depended On the Parents Of informant for food and livelihood. ln the year 2021, Petitioner/Accused No.1 took Rs.2,00,000/-from his in-laws and established a lab in his name. 3 AHHS,J Crl.P.No.5800 of 2025 the year 2024, informant purchased FIa{ No.405, Surya Towers SenI-Vada Aganampudi by taking a housing loan with her salary. Petitioner/Accused No.1 demanded for transfer of property in his name and used to bet her by demanding addI-tiOnal dowry etC, Periodical administration of sleeping pills were also there on her and finally, the children were taken away by the husband/ PetI-tiOner-Accused No.1. 6. The petitioners/accused Nos.1 and 2 denied all the allegations. 7. Learned counsel forthe petitioners/accused Nos.1 and 2 submitted that due to minor matrimonial disputes between them this case is foisted wl'th false allegations without any basl-s. Earlier once the matter was taken before the Lok-Adalat and an undertaking was also given by the informant that the Petitioner/Accused No.1 and she will lead the matrimonial life, the criminal complaint and the allegations are false and she withdrew them. The petitioner, No.2 is the mother of the petitioner No.1, who is lady, is ready to abide by all the conditions and is taking care of the children as well. 8.
Learned Assistant Public Prosecutor submI'tted that 8 witnesses were examined among them L.W.6, L.W.7 and L.W.8 are neighbours who have stated that there are differences and disputes between the petitioner No.1 and the informant. 9. 10. ln the result, the Criminal Petition is allowed, On the following conditions: 1) Petitioners/Accused Nos.1 and 2 shall be released on bail in the event of their arrest in respect of cr. No.184/2025 of Duvvada Police Station, which was registered with the allegation of committing offences under sections 85, 308(5), 137(2), 108 r/w 62 r/w 3(5) of the Bharatiya Nyaya sanhita, sectionsL 3 and 4 of the Dowry Prohibition Act, on the condition Of petitioners/Accused Nos 1 and 2 executing ba'll bonds for Rs.20,000/-with two sureties each for a like sum to the satisfaction of the S.H.O., Duvvada Police station, visakhapatnam Comm-lssionerate. 2) The Petitioners/Accused Nos. 1 and 2 and their sureties Shall furnish their permanent residential address deta'lls and identity particulars to the concerned police and keep the police informed about the change in address. , if any, time to timeI 3) For the purpose of eXPedi{'lng the investigation Process, the petitioners/accused Nos. 1 and 2 are directed to appear before the concerned s.H.O./ after release on bail on every alternative Saturdays between 10 a.m. to 2.00p.m. for a period of Six (6) weeks or till filing Of the Charge Sheet, wh-lchever is earlier. 4) The pet-ltioners/accused Nos. 1 and 2' shall co-operate With the investigat'lon agency, by furnishing necessary and legally permissible information and they shall not interfere with the investigation process like contacting or influencing the witnesses etc. / I--- -
