For Petitioner : Mr. Father Xavier Arul Raj, Senior Counsel For Respondents : Mr. K.Prabakar O R D E R The captioned writ petition has been filed challenging the order dated 05.08.2022 passed under Section 45(G) of the Employees’ State Insurance Act, 1948, by which an amount of Rs. 8,05,361/- is sought to be recovered as arrears towards ESI contribution. 2. The learned counsel for the respondent has placed on record a copy of the New Amnesty Scheme, 2025. 2 https://www.mhc.tn.gov.in/judis W.P No. 29341 of 2022 3. Admittedly, the writ petitioner has not challenged the order passed under Section 45(A) of the ESI Act, 1948. Having accepted the said order, the petitioner-College cannot absolve itself of the liability to pay the said amount towards ESI contribution. Therefore, the captioned writ petition is devoid of merit and liable to be dismissed, as the impugned order has been passed strictly in conformity with Section 45(G) of the ESI Act, 1948. 4. In view of the above, the writ petition stands dismissed. Consequently, the connected miscellaneous petitions are closed. No costs. However, liberty is granted to the petitioner to avail the benefits of the New Amnesty Scheme, 2025, dated 24.07.2025, issued by the ESI Corporation.
