Heard Mr. R. De, learned counsel appearing for the petitioner. Also heard Mr. B. Sharma, learned Addl. Public Prosecutor appearing for the State. By this application, the petitioner has prayed for bail in connection with
Page No.# 2/3 Badarpur P.S. Case No. 166/2025 corresponding to G.r. No. 1303/2025 under Section 118(2) of BNS, 2023. The FIR dated 16.09.2025 reveals that the petitioner who was a student of 7th semester B.Tech Civil Engineering Department, assaulted another student in the same institution and have caused grievous injury. Mr. R. De, learned counsel appearing for the petitioner submits that the forwarding report demonstrated that the petitioner had not assaulted the fellow student but there was a quarrel and in midst of the same, the petitioner had bit on the ear of the victim and has caused injuries but he submits that there was no intention on the part of the petitioner and it all happened at the spar of the moment during quarrel. Mr. B. Sharma, learned Addl. Public Prosecutor however submits that the petitioner being a student should not have committed such an act as the same is unbecoming of a student studying in the Engineering College. He has also placed the rejection order dated 25.09.2025. Upon consideration of the submissions made at the bar and on perusal of the FIR as well as the forwarding report which shows that there was quarrel between the students in the college and the incident had happened, this Court finds it fit that the petitioner may be released on bail on furnishing of a bail bond of Rs. 20,000/-(Rupees twenty thousand) with one (1) local surety of the
Page No.# 3/3 like amount to the satisfaction of CJM, Sribhumi under the following conditions:- 1) The petitioner shall cooperate with the investigation and shall appear before the CJM, Sribhumi as and when called for.
2) The petitioner shall not tamper with the evidence or influence any of the witnesses. 3) The petitioner shall not leave the jurisdiction of the CJM, Sribhumi without prior permission of the said Court. The petition is disposed of. JUDGE Comparing Assistant
