Nuruddin Khan, learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 to 5 and Shri Bhupendra Kumar Tripathi, learned counsel for the respondent no.6 Gaon Sabha. 2. The present petition has been filed by the petitioner challenging the order of Deputy Commissioner (Self Employment), Jaunpur, dated 15.09.2025, by which Vanvasi Swam Sahayata Samuh has been held ineligible for grant of fair price shop dealership under the scheme of Uttar Pradesh Rajya Gramin Ajivika Mission Yojna. 3. Learned Standing Counsel, on the other hand, on the basis of instructions received, has informed that Sub Divisional Officer, Mariyahun, Jaunpur has already approved fair price shop dealership in favour of Ambedkar Swam Sahayta Samuh by his order dated 08.10.2025. The said order is appealable under Order 13(1) of the U.P. Essential Commodities (Sale and Distribution) Order, 2016 before the Divisional Commissioner. 4. In view of the aforesaid facts, the present petition is disposed of with liberty to the petitioner to avail alternative remedy of filing an appeal before the Commissioner of the Division under the aforesaid provision.
