1. Heard Mr. Raza Ali, learned counsel for the petitioner as well as Mr. Prafull N. Bharat, learned Advocate General assisted by Mr. Shashank Thakur, Deputy Advocate General, appearing on behalf of the State/respondents. 2. The present petition has been filed by the petitioners with the following reliefs:-
“A. A writ and/or an order in the nature of appropriate writ do issue calling for the records of the case pertaining the petitioners' case from the respondent concerned if this Hon'ble Court may deem fit in the facts and circumstances of the case.
B. A writ and/or an order in the nature of writ of certiorari do issue quashing the notice inviting tender (Annexure P-1) so far as it relates to work awarded to petitioners herein i.e. Tender No.315/07.04.2025 System No. 166681, Bardar Group Multi Village Water Supply Scheme at Khadgawan, District

being illegal, arbitrary and in gross violation of petitioners' fundamental, constitutional and contractual rights under the agreement entered into between the parties in the facts and circumstances of the case. C. Any other relief which this Hon'ble Court may deem fit in the facts & circumstances of case. D. Cost of the petition may also be awarded.”
3. It has been pointed out by learned counsel for the parties that in an identical matter, this Court had disposed of Writ Petition (C) No.2154 of 2025 vide order dated 01.05.2025 observing as follows :-
“At the outset, Mr. Bharat, learned Advocate General appearing for the State/respondents submits that the respondent Department has already stayed the NIT in question and as such, nothing survives in this petition for adjudication at this stage. In view of the above submission, since the NIT issued by the respondent authorities itself have been stayed, the grievance raised in this batch of petitions stands redressed
4 and no further adjudication is warranted. Needless to state that if the NIT in question, which has been stayed by the respondent authorities itself, is revived, the petitioners may take recourse to appropriate forum afresh, if so advised. From perusal of the documents annexed with the petitions, it appears that earlier, the petitioners had filed a petition being WPC No. 1263/2025 and other connected matters wherein they had sought quashing of the show cause notice and the entire exercise of the respondent authorities to be an eye wash exercise as the superior authority had already directed the authority dealing with the show cause notice to pass particular order and impose particular penalty.
The aforesaid petitions were heard by a learned Single Judge of this High Court and those petitions were disposed of vide order dated 07.03.2025 by quashing the show cause notice dated 03.09.2024 impugned in those writ petitions and the direction issued
5 in pursuance of the resolution of the Committee dated 17.02.2025 was also quashed.” They further submitted that since the facts and issue involved in the present case is identical to that of Writ Petition (C) No.2154 of 2025, which was decided on 01.05.2025, this petition may also be disposed off in the same terms. 4. Having considered the rival submissions made by learned counsel for the parties and having gone through the materials on record, it is evident that the facts and issue involved in this appeal is identical to Writ Petition (C) No.2154 of 2025 and analogous petitions, this Court deems it appropriate not to take a view other than what has been taken in Writ Petition (C) No.2154 of 2025. 5. Accordingly, the present writ petition is disposed of in terms of the order dated 01.05.2025 passed in Writ Petition (C) No.2154 of 2025 and analogous petitions. Sd/- Sd/-
