Heard Sri Azad Khan, learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 and 5 and Sri Vibhanshu Vaibhav, learned counsel for the respondent nos.2, 3 and 4. 2. The present writ petition has been filed challenging the order of the respondent no.3 dated 1.11.2022 passed under Section 28-A(1) of the U.P. Urban Planning and Development Act, 1973 and the order of the respondent no.5 dated 17.9.2025 passed in appeal under Section 28-A(4) of the aforesaid Act of 1973. 3. It is contended by learned counsel for the petitioner that he has already filed a compounding map on 21.10.2022 before the respondent no.4, before the order dated 1.11.2022 was passed by respondent no.3. Without taking any decision on the compounding map of the petitioner, the constructions of petitioner has been sealed. The respondent no.5 in appeal has also not adhered to this fact before dismissing the appeal. 4. It is admitted that the construction raised by petitioner is in absence of any requisite permission under Sections 14 and 15 of the Act of 1973. However, he has submitted a compounding map before the competent authority, on which no decision has been taken till date. 5. In view of the aforesaid facts, the present writ petition is disposed of with a direction to the respondent no.2 to take a decision on the compounding map submitted by the petitioner, in accordance with law, within a period of Versus Counsel for Petitioner(s) : Azad Khan, Talha Uzair Usmani Counsel for Respondent(s) : C.S.C., Vibhanshu Vaibhav Mohd Kaleem .....Petitioner(s) State Of U.P.
