HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22578 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J. HON'BLE SANJIV KUMAR, J. Heard Mr. Vivek Srivastava, learned counsel for the petitioner and Mr. Ghan Shyam Kumar, learned AGA on behalf of the State. Land which had already been sold to one Guddo wife of Subhash vide registered sale deed dated 23.09.2022 was sold to the informant by the petitioner vide registered sale deed dated 18.04.2024. The case in the FIR is that this could be done because the first vendee Guddo's name was not mutated in the revenue records and that of the original owner continued to be recorded, enabling the petitioner to perpetrate this act of cheating. Upon a perusal of the impugned FIR and the fact that the land which has been sold to the informant was already sold, we do not find this to be a fit case for interference in exercise of our jurisdiction under Article 226 of the Constitution. This writ petition is summarily dismissed. October 14, 2025 Subham Versus Counsel for Petitioner(s) : Vivek Srivastava Counsel for Respondent(s) : G.A. (Sanjiv Kumar,J.) (J.J. Munir,J.)
