The allegation against him is that the applicant committed rape upon the slow witted minor daughter of the informant aged about 17 years while she was sleeping on the roof, on account of which she became pregnant. Learned counsel further submits that though the victim in her statements recorded under Section 161 & 164 Cr.P.C. has made specific allegation of rape against the applicant, when it was informed to the Court that victim has given birth to a child then this Court vide order dated 30.05.2025 directed the Investigating Officer to get the DNA profile of the applicant matched with the child born to the victim and submit report and if required DNA test of the victim shall also be conducted and pursuant to that order the State has filed complaince affidavit dated 24.06.2025, annexing FSL report of the DNA test, as per which the applicant is not the biological father of the child born to the victim. Per contra, learned A.G.A. has opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged before conclusion of trial, therefore, he does not deserve any indulgence, but he has not disputed the above facts asserted on behalf of applicant. 6. After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, the nature of evidence and also the absence of any convincing material to indicate the possibility of tampering with the evidence, without expressing any opinion on merits of the case, this Court is of the view, that the applicant may be enlarged on bail.
