It has been informed to this Court that the order dated 20th April, 2023 (supra) has been challenged before the Supreme Court by way of an SLP (C) No.019199 of 2023 (State of UP Vs. Surendra Singh), which is pending, therefore, while deciding afresh, the said respondent will take note of aforesaid circumstances as well as its outcome. The impugned order is set aside.
