Mr. Vishal Agarwal, learned advocate appears on behalf of petitioner and submits, his client had applied for issuance of work order pursuant to notice dated 21st April, 2025 issued by respondent nos. 2 and 3 (the Nagar Nigam). On repeated follow up, the authority continued to say that the bids were undergoing check. Then, without informing his client any reason, by impugned cancellation order dated 22nd August, 2025 the invitation to tender was rejected. On same day fresh tender notice was issued. He seeks interference for quashing the cancellation order and for direction to issue his client, work order. 2. Mr. Raj Mohan Upadhyay, learned advocate, Additional Chief Standing Counsel appears on behalf of State. Mr. Jai Bahadur Singh, learned advocate appears on behalf of respondent nos. 2 and 3. He submits, there were irregularities found in the initial tender bids. The tender was cancelled. Subsequent tender notice was issued. Date for putting in bids expired on 2nd September, 2025. There be no interference. 3. On query Mr. Agarwal submits, his client did not put in bid against the fresh tender notice. He submits, in the circumstances there be refund of all moneys deposited as tender and processing fees in the cancelled tender. 4. The Nagar Nigam will refund to petitioner tender and all fees, paid by petitioner on the cancelled tender. Petitioner will produce certified copy of this order to respondent no.3. The refund is to be made within two Versus Counsel for Petitioner(s) : Vishal Agarwal Counsel for Respondent(s) : C.S.C., Jai Bahadur Singh M/S Maa Shri Vaishno Devi Construction Company .....Petitioner(s) State Of U.P.
