Mr. Ashish Agrawal, Advocate appears on behalf of respondent no. 3 and has produced before us a certified copy of the charge-sheet on which the Special Chief Judicial Magistrate has taken cognizance on 01.10.2025. He has also produced before us a certified copy of the summoning order also dated 01.10.2025 passed by the Special Chief Judicial Magistrate, Varanasi. The certified copy of the charge-sheet and the summoning order are retained on record. In view of the fact that Police report has been filed and summoning order made, we are of opinion that this writ petition, which challenges merely an FIR, is no longer maintainable. It is dismissed as not maintainable with liberty to the petitioner to challenge the charge sheet and the summoning order in such a manner as advised.
