This is a Civil Revision Petition filed under Article 227 of the Constitution of India, 1950 for setting aside the impugned order dated Davinder Kumar 2025.09.01 17:17 I attest the accuracy and authenticity of this order / judgment CR-336-2021(O&M) 2 12.01.2021 passed by the Civil Judge (Jr.Div.), Mohali, vide which application under Order VII Rule 11 CPC filed by the petitioner-defendant for rejection of the plaint dated 25.09.2020 has been dismissed. 2. Learned counsel for the petitioner has fairly submitted that since in the present case, written statement has already been filed, the petitioner be permitted to withdraw the present petition with liberty to raise all the pleas, which have been raised in the present petition and are available to him during the course of trial. It is submitted that the trial Court be requested to decide the civil suit independently in accordance with law. 3. In view of the statement made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty. The trial Court would decide the civil suit after hearing both the parties concerned on the basis of evidence led by both the parties independently in accordance with law.
