ORDER:
1. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of pre-arrest Bail. The petitioner is arrayed as accused No.2 in Cr.No.43/2025 of Karempudi Police Station, Palnadu District, which was registered with the allegation of committing the offences under Sections 307, 448, 427, 386, 509 r/w 34 of the lndl-an Penal Code (Sections 109, 329(4), 324, 308 79 r/w 3(5) of the Bharatiya Nyaya Sanhita). 2. The petitioner prays for directions to release on Bail, in the event of arrest. 3. Heard both sides. 4. Point for determination: (i) whether the petitioner/accused is entitled for grant of pre-arrest bail in terms of Section 482 Qf BNSS? lf so, on what terms? 5. The allegations against the petitioner/Accused No.2 in brief are that the I'nfOrmant-Gamidi Purnachandra Rao and his family belongs to political ideology of one party and the petitioner/Accused No.2 belongs to another political party. The petitioner/Accused No.2 along with others since 18.12.2022 used to bring pressure on the informant's family to change the Party and Support the Party tO Which the Petitioner/Accused No.2 belongs to. The contention of accused is that the informant family has good influence in ------_J`

No.5792 :fH2HoS£gr the village, if the I-nformantJs family is brought to the political party to which the petitioner/Accused No.2 belongs to there will be advantage but, when the same demand was not accepted on 12.ll.2023 at about 10.loo in the nl-ght, the petitioner along with others entered house of informants and threatened them, attacked with the knives, rods e{c and they have taken Rs.30,000/-also. 6. The petitioner/Accused No.2 denied all the allegatI-OnS. 7. The case of the petitioner/Accused No.2 is that, the complainaflt I'S / POlitI'Cally motivated due to change of polI|tI'Cal scenario I'n the State and the allegations are false. The alleged incident is of the year 2023 where as the case was registered on 28.5.2025. The petitioner is law abiding citizen and ready to comply conditI'OnS imposed by this Court. 8. It is submI'tted by the prosecutor, the petitioner is involved in other cases also. Answering the same, learned counsel for the accused, submitted that in all the cases bails were granted consI-dering the merI'tS and he is referred to a bail order passed by the co-ordinate Bench of this court I'n respect Of another Crime V,'C/e Crl.P.No.371 of 2025.
It js also submitted by the learned Assistant Public Prosecutor that 6 witnesses were examined, A3 is absconding and Al has been arrested in the present case. ` 9. Upon considering the facts and circumstances of the case, the nature and depth of the allega{I'OnS, the Prayer for grant Of Pre arrest bail found convincI'ng. 10. In the result, the Criminal Petition is allowed, on the following conditions: •=` ng

A, 4 AHHS, J CrI.P.No.5792 of 2025 1) Petitioner/Accused No.2 shall be released on bail in the event of his arrest in respect of Cr.No.43/2025-of Karempudi Police Station, which was registered with the allegation of committing offences under sections 307, 448, 427, 386, 509 I/w 34 of the IPC, on the condition of petitioner/Accused No.2 executing bail bonds for Rs.20,000/-with two sureties each for a like sum to the satisfactl'on of the S.H.O., Karempudi Police Station, Palnadu DI'StriCt. 2) The Petitioner/Accused and his sureties shall furnish theI'r Permanent' residential address details and identity particulars to the concerned police and keep the police informed about the change in address, if any, time to time. 3) For the purpose of expediting the l'nvestI'gatiOn Process, the Petitioner/accused is directed to appear before the concerned s.H.O./ after release on bail on every alternative Saturdays between 10 a.m. to 2.00p.m. for a period of (8) weeks or till filing of the charge sheet, whichever is earlier. 4) The petitI'Oner/accused Shall co-operate with the investigation agency, by furnishing necessary and legally permissible I'nfOrmatiOn and he shall not interfere with the investigation process like contacting or influencing the witnesses etc. 5) The petitioner/accused shall not leave India, without permission of the concerned court. . \ /.` REiil
