Respondent(s) For Petitioner : None, even in the second round For State : Mr. Vedang Shadangi, Advocate For Respondents No.3 & 4 : Mr. Sushobhit Singh, Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 03.02.2025 1) The petitioner has filed this petition seeking the following relief(s):- “10.1.That, this Hon'ble Court may kindly be pleased to call for the entire records in relates to the case of the petitioner from the possession of respondents for its kind perusal. -2- 10.2 That, this Hon'ble Court may kindly be pleased to set aside the impugned order dated 28.02.2018 (ANNEXURE-P/ 1) issued by the respondent no.4, whereby the contract service of the petitioner to the post of Rajgar Sahayak has not been renewed. 10.3 That, this Hon'ble Court may kindly further be pleased to direct the respondents to allow the petitioner to continue to the post of Rajgar Sahayak at village Markamgodhi, Janpad Panchayat Sakti. 10.4 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner.” 2) Mr. Sushobhit Singh, learned counsel appearing for respondents No. 3 & 4, submits that the petitioner was initially appointed on a contractual basis as a ‘Rojgar Sahayak’ at Gram Panchayat Markamgodhi, Janpad Panchayat Sakti, District Janjgir-Champa, for a period of one year vide order dated 26.12.2016. He further submits that the petitioner’s services were discontinued on 28.02.2018 taking into consideration Annual Confidential Report and past work assessment. He also contends that the order dated 28.02.2018 is not a stigmatic, and that the services of a contractual employee can be discontinued at any time. 3) Mr. Vedang Shadangi, learned Panel Lawyer appearing for the State, supports the submissions made by Mr. Singh. 4) Taking into consideration the fact that the services of the petitioner were discontinued simpliciter and the impugned order is not stigmatic, this Court is of the opinion that there was no need for respondents to conduct an inquiry before passing such order impugned; thus, no case is made out in favor of the petitioner.
