Heard Sri Sumit Chauhan, learned counsel for the petitioners and learned A.G.A. for the State. 2. This writ petition has been filed by the petitioner for the following prayer :- (i) Issue a writ, order or direction in the nature of mandamus directing the opposite parties no 1 to 3 to secure the marital life and liberty of the petitioners and their family members in any manner. 3. Learned counsel for the petitioners submits that both the petitioners are major and have solemnized their marriage with their sweet and free will on 31.8.2025 but since the family members of petitioner no. 1 is not happy with their marriage, therefore, the petitioners are facing harassment by the police at the instance of respondent no. 4, who is father of petitioner no. 1. The petitioners thus pray for protection of their marital life and liberty from any undue interference and harassment. 4. Learned A.G.A., on the basis of instructions submits that there is no FIR against the petitioner no. 2 and the petitioners are not being harrassed by the police nor there is any interference in their marital life. 5. In view of the above, the petition stands disposed of in terms of the statement made by learned A.G.A. 6. Even otherwise the petitioners are entitled to have the benefit of the mandate of Hon'ble the Supreme Court in the case of Lata Singh Vs. State of U.P. and another, 2006 (5) SCC 475, the relevant Para-17 of which is extracted below:- "17..... We, therefore, direct that the administration/police authorities throughout the country will see to it that if any boy or girl who is a major undergoes inter-caste or Versus Counsel for Petitioner(s) : Sumit Chauhan, Ashutosh Srivastava, Pratibha Maurya Counsel for Respondent(s) : G.A. Ramrati @ Kumari Ramrati And Another .....Petitioner(s) State Of U.P. Thru. Secy. Home Govt. Lko. And Others .....Respondent(s) inter-religious marriage with a women or man who is a major, the couple is not harassed by anyone nor subjected to threats or acts of violence, and anyone who gives such threats or harasses or commits acts of violence either himself or at his instigation, is taken to task by instituting criminal proceedings by the police against such persons and further stern action is taken against such persons as provided by law."
