1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No.115/2025 registered at Police Station –City Kotwali, Sarangarh, District Sarangarh- Bilaigarh (C.G.) for the offences punishable under Sections 115 (2) & 191 (2) of Bhartiya Nyay Sanhita.

Case of the prosecution, in brief, is that in relation to the matter of providing water to the field, some dispute arose between Than Singh and Anand Ram and later on Than Singh started irrigating his field by stopping the water of Anand Ram Kosle and when they were returning home, at that time, the applicants stopped them and committed Mar-peet with them, as a result of which the offences registered against the present applicants.

Learned counsel for the applicants submits that the applicants are innocent and they have been falsely implicated in this case. He further submits that one co-accused person namely Manbodhi Koshle has already been granted anticipatory bail by this Court in MCRCA No.534/2025 on 22/04/2025. Therefore, he submits that the present applicants are also entitled to be released on anticipatory bail.

4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail and she would submit that there is counter FIR has also been registered.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts & circumstances of the case, submissions of
learned counsel for the parties, considering the fact that one co-accused person namely Manbodhi Koshle has already been granted anticipatory bail by this Court in MCRCA No.534/2025 on 22/04/2025 and also considering the fact that counter FIR has also been registered, therefore, I am inclined to grant anticipatory bail to the present applicants.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of applicant No.1– Lakki Gend Kumar Koshle, applicant No.2 Shankar Koshle, applicant No.3 Siyaram Koshle, applicant No.4 Premlal Koshle, applicant No.5 Anandram Koshle, applicant No.6 Jagdish Koshle & applicant No.7 Seetaram Koshle, on each of them executing a personal bond and one surety in the like sum to the satisfaction of the arresting OfÏcer, they shall be released on bail on the following conditions:- (a) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicants shall appear before the trial Court on each
4 and every date given to them by the said Court till disposal of the trial. (d) The applicants and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicants shall not involve themselves in any offence of similar nature in future. Sd/-
