THIS W.P IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE PROCEEDINGS IN R.R.T (DISPUTE) C.R.NO.435/2024 PENDING BEFORE THE R3 TAHASILDAR, HIRIYUR CHITRADURGA PRODUCED AT ANNEXURE-A AND ETC.,
THIS W.P, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE N S SANJAY GOWDA
ORAL ORDER The petition is filed challenging the proceedings that have been initiated by the Tahasildar for change of khata. 2. It is the case of the petitioner that she has filed OS.No.166/2024 seeking for partition in respect of all the 11 items and despite objections being filed to the request by respondent No.1 and 2, the Tahasildar is in a hurry to change the Khata. - 3 -
NC: 2025:KHC:10621 WP No. 7358 of 2025
3. Since the petitioner contends that she has filed objections, in which, she has specifically stated that she had instituted a suit in OS No.166/2024 seeking for a partition, it is obvious that Tahasildar will have to consider this objection and only then pass an order on the request of respondent Nos.1 and 2 for change of khata. 4.
The petition is therefore disposed of directing the Tahasildar to consider the objections raised by the petitioner, including the specific objection that she has filed a suit for partition in respect of properties in question. Sd/- (N S SANJAY GOWDA) JUDGE BH: List No.: 1 Sl No.: 35
