The applicant has preferred this application under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No.175/2025, registered at Police Station – Gudhiyari District – Raipur (C.G.) for the alleged commission of offence punishable under Sections 331(6), 296, 351(2), 115(2) and 3(5) of BNS. 2. As per the prosecution story, on 14.03.2025 the complainant Devendra Thakur was at home with his family when Raghu VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.05.06 11:32:43 +0530 2 Sahu, Rajendra Patel, Neha Kaushal and the present applicant came before his home were in the colors of Holi and were abusing in an inappropriate way. When the complainant asked them to not do the same, Raghu Sahu and his accomplices forcefully entered his home and threatened him with his life, and thereafter Raghu Sahu hit the complainant with a wooden stick on his head and right shoulder. When the children and wife of the complainant tried to diffuse the situation, they were also hit by Raghu Sahu. Hence, this bail application. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that the applicant is a student at Industrial Training Institute and is about to take the examination and therefore may be considered to be protected from his arrest. He further submits that the applicant comes from a well-to-do family and is a 20 year old person from Raipur and he is only friend of the other co- accused persons. Therefore, he prays for grant of anticipatory bail to the present applicant. 4. On the other hand, learned State counsel opposes the submission made by the learned counsel for the applicant submits that the applicant is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the nature and gravity of the offence and material on record in the case diary and also considering the fact that applicant is a 20 years old person boy and along with other co- accused threatened to complainant and hit with wooden stick, by which complainant received injuries on his head and right shoulder as such, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant– Priyanshu Baghel, filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.175/2025, registered at Police Station–Gudhiyari District – Raipur (C.G.) for the alleged commission of offence punishable under Sections 331(6), 296, 351(2), 115(2) and 3(5) of BNS, is rejected.
