Learned Counsel, Ms. Saswati Nag is present on behalf of the petitioners.
Learned Counsel, Mr. Arjun Acharjee is present on behalf of the respondent No.1. Learned Addl. P.P., Mr. Rajib Saha is present on behalf of the State-respondent.
In pursuance of the order of this Court, one affidavit is submitted by the respondent-complainant stating that the respondent-complainant has received the entire amount from the accused-petitioner and as such, he has got no grievance.
Perusing the record, it appears that Learned CJM, South Tripura, Belonia by judgment dated 24.02.2021 delivered in
connection with N.I./8/2018 convicted the present petitioner under Section 138 of N.I. Act and sentenced him to pay fine of Rs.50,000/- along with the cheque amount i.e. Rs.5,30,000/- i.e. in total Rs.5,80,000/- in default to suffer S.I. for 6(six) months. Challenging the judgment, the present petitioner preferred one appeal before the Court of Learned Sessions Judge, South Tripura, Belonia which was numbered as Crl. A./2/2021. Learned Sessions Judge, South Tripura, Belonia disposed of the appeal by judgment dated 10.07.2024 affirming the order of conviction and sentence passed by Learned Trial Court i.e. Learned CJM, South Tripura, Belonia. Challenging the judgment delivered by Learned Sessions Judge, South Tripura, Belonia, this revision petition was filed before this Court.
During the pendency of this petition, the matter was sent for mediation by this Court and in course of the mediation proceeding, the subject matter was settled between the parties for an amount of Rs.5,40,000/- and accordingly, a report was submitted by the Coordinator, Mediation Centre, High Court of Tripura. Since the parties have settled the disputed amount at Rs.5,40,000/- out of Rs.5,80,000/- and by this time, the entire amount has been realized by the respondent-complainant, as such, no purpose would be served by keeping this revision petition pending any more.
Accordingly, in view of the terms and conditions arrived at during the mediation proceeding, this revision filed by the
petitioner stands disposed of on the ground of composition and the sentence be set aside accordingly.
The present petitioner is accordingly stands discharged/exonerated from the liability of the case for which he was convicted.
Pending application(s), if any, also stands disposed of.
A copy of this order be supplied to the Learned Trial Court. Also, a copy of this order be supplied to Learned Counsel for both the parties.
