HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 6361 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J.
1. Heard learned counsel for petitioner and Mr. V.K. Bajpai learned state counsel for opposite parties 1 to 5. In view of order being passed, notice to opposite party No. 6 stands dispensed with. 2. Petition has been filed challenging selection of opposite party No. 6, Poonam Devi, wife of Lav Kumar on the post of Anganwadi Worker in the center concerned by way of the final select list dated 16th April 2025. Further prayer for a direction to the opposite parties to consider candidature of petitioner for appointment on the said post has also been made. 3. Learned counsel for petitioner submits that opposite party No. 6 has been appointed on the basis of incorrect information supplied due to which an incorrect income certificate was issued in her favour and is the basis of her appointment. It is submitted that petitioner is in fact eligible and better place than opposite party No. 6 for such appointment. 4. Learned state counsel has refuted submissions advanced by learned counsel for petitioner with submission that the appointment of opposite party No. 6 being based on the income certificate, cannot be cancelled until and unless the income certificate itself stands cancelled. It is submitted that it is not the case of petitioner that the income certificate of opposite party No. 6 has ever been cancelled. Versus Counsel for Petitioner(s) : Santosh Kumar Dwivedi, Sandeep Singh Counsel for Respondent(s) : C.S.C. Neha .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Chief Development Nutrition Deptt. Lko And 5 Others .....Respondent(s)
5. Upon consideration of submissions advanced by learned counsel for parties and perusal of the material on record, it is evident and admitted that appointment of opposite party No. 6 on the post of Anganwadi Worker is on the basis of income certificate submitted by her. Admittedly the said income certificate has not been cancelled or revoked by any competent authority and in such circumstances, there does not appear to be any occasion to interfere with the appointment of opposite party No. 6. 6. Considering aforesaid facts and circumstances, the petition fails and is dismissed at the admission stage itself. Parties to bear their own costs.
