ORDER: This Criminal PetI'tiOn, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.53/2016 of K.D.Peta Police Station, Anakapalle DistrI'Ct. 2. A case has been registered against the petitioner and others for the offences under sections 20(b)(ill)(C) read with 8(c) of the Narcotic Drugs and Psychotropic substances Act. 3. Case of the prosecutl-on I'S that On 29.ll.2016 at about 5.00 am, on receipt of credible information regarding illegal possessI'On and transportation of ganja, the s.I of Police, K.D.Peta Police Station, along with staff reached chodyam Junction, Golugonda Mandal and started conducting vehicle checking. At that time, they found two persons coming by Auto, and on seeing the police, the inmates in the Auto stopped the auto and tried to escape. Then police apprehended them. on interrogation, they disclosed their identity particulars as A2 and A3 and police seized 60kgs of ganja from their possession. They confessed that they purchased the same from Petitioner/A1. Police seized the contraband, arrested the accused and got remanded to judicial custody. Police arrested the petitioner on ll.4.2025. 4. Heard. Perused the record. -rir.g"

5. Learned Assistant Public Prosecutor submits that major part of the investigation is completed except filing of charge sheet. 6. A perusal of the material available on record goes to show that the petitioner was arrested and remanded to judicial custody on ll.4.2025. Police on credible information seized 60 kgs of ganja from A2 and A3. Pursuant to the confessional statement of co-accused, nothing has been seized from the petitioner to connect the petitioner with the crime. Basing on the confessional statement of co-accused, the petitioner has been arrested and remanded to judicial custody. 7. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/Al herein, on the following conditions. (i) The petitioner/Al herein shall be released on his executing a Personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge-cum-Special Judge for Trial of Offences Under NDPS Act, Visakhapatnam; (ii) On release, the petitioner shall appear before the station House Officer concerned once in a week I-.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. 8. Accordingly, the Criminal Petition is allowed.
