Heard learned counsel for the applicant and learned A.G.A. for the State. 2. This application has been filed with the following prayer:- "To quash the summoning order dated 07.09.2024 as well as proceeding arising from the Crl. Misc. Case No. 440 of 2024 (State Vs. Mohd. Kalim)." 3. Sri Piyush Kumar Singh, learned A.G.A. raises preliminary objection and submits that the proceeding u/s 22 of P.O.C.S.O. Act has been initiated in compliance of the directions issued by learned Special Judge, P.O.C.S.O. Act, Gonda on 03.09.2024 in Special Session Trial No. 75 of 2018 (State Vs. Afridi and Ors.) arising out of Crime No. 141 of 2018 u/s 376, 504, 506, 452 I.P.C.. He further submits that as the aforesaid order dated 03.09.2024 has not been challenged, the consequential proceeding registered in pursuance of the aforesaid directions cannot be challenged. 4. At this stage, learned counsel for the applicant requests for withdrawal of the present application with liberty to take appropriate remedy. 5. Accordingly, the application is dismissed as withdrawn. 6. Office shall return the certified copies of the annexures annexed with the application to learned counsel for the applicant after taking photocopies of the same.
