HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 1101 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 385 of 2024, under Sections 3(5), 80(2), 85 BNS and Sections 3/4 D.P. Act, P.S. Beekapur, District Ayodhya/Faizabad. 3. It is contended that the FIR in question was lodged alleging that the sister of the informant was married to the applicant in the year 2019 and subsequently on account of demand of dowry, the sister was killed. The postmortem report on record indicates the cause of death as ante mortem hanging. It is also argued that the two of the co-accused have been enlarged on bail. 4. Learned AGA has opposed the bail application. 5. Considering the post mortem report coupled with the fact that the petitioner is in custody since 25.10.2024 and has no criminal history, however, without commenting upon the merits of the case, the applicant is entitled to be enlarged on bail. In view thereof, the application is allowed.
