HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 2934 of 2025 Court No. - 11 HON'BLE ABDUL MOIN, J. HON'BLE MRS. BABITA RANI, J. 1. Heard learned counsel for the petitioner, learned AGA for respondents no.1 to 3, and Sri Shivam Rai, learned counsel for respondent no.4. 2. Pursuant to earlier order of this Court, the petitioner and respondent no.4 are present in Court. 3. Learned counsels for the contesting parties state that the petitioner as well as the complaint/informant i.e. respondent no.4 have got married on 28.05.2025 and that the marriage has also been registered before the Marriage Registering Authority. However, the disputes are still continuing amongst the parties. 4. The Court is of the view that once the petitioner and respondent no.4 have got married consequently for any dispute that may still subsist between the parties the matter could be referred to the Mediation Center of this Court in order to iron out the said differences but respondent no.4 has refused to go in for mediation. 5. Considering the aforesaid as well as the averments made in the FIR per which a cognizable offence is made out, it is not possible to quash the FIR keeping in view the law laid down by Apex Court in the case of Niharika Infrastructure Private Limited vs. State of Maharashtra - 2021 (19) SCC 401. Accordingly, the writ petition is dismissed leaving it open to the petitioner to pursue other remedy as may be available to him under law. October 8, 2025 A.
