1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 2. The applicant seeks enlargement on bail in FIR No.30 of 2021, under Section 328, 363, 366, 376D, 346, 323 IPC and Section 3(2)(v) of SC/ST Act and Section 5/6 of POCSO Act, Police Station Bhadokhar, District Raebareli. 3. The FIR in question was lodged alleging that the daughter of the informant was enticed by the applicant. Subsequently, it is stated by both the parties that the victim and the applicant had married and are staying together since 2020. The statements under Section 161 and 164 of Cr.P.C. do not support the prosecution story. The bail application of the applicant was rejected some time in the year 2021, however, on account of poverty, he could not approach this Court. 4. Learned A.G.A. vehemently opposed the bail prayer. 5. Considering the two statements of the victim and the fact that the applicant and the victim had married and are staying together coupled with the fact that the applicant has no criminal antecedents and is languishing in jail since 20.02.2021, I am of the view that the applicant is entitled to be released on bail.
