The petitioner by filing this writ petition seeks for a direction upon the respondents to take appropriate steps so that the accused in Complaint Case No.1544/2021 can serve the sentence. 3. After hearing the parties, I find that the accused of Complaint Case No.1544/2021 was convicted by Judicial Magistrate, Koderma and his appeal was also dismissed. Ultimately the conviction was sustained and confirmed. 4. Once, the conviction has been confirmed, the convict has to serve the sentence. The Police Officials are not seriously trying to apprehend the convict so that he may serve the sentence. 5. After going through the record, I find that the 2025:JHHC:21078 2 Magistrate at Koderma has already issued non-bailable warrant of arrest. Since, the accused is from the State of Bihar, the warrant has also been sent to the State of Bihar. The Superintendent of Police, Nawada, has written to the Officer-in-Charge of Nagar Police Station, Nawada who has to execute the warrant. The said letter was written on 02.04.2025. 6. Considering the fact that steps are being taken to arrest the convict to enable him to serve the sentence, I am disposing of this writ petition with a direction to the Judicial Magistrate, First Class, Koderma to take appropriate steps in Complaint Case No.1544/2021 and monitor the same and take all steps to procure appearance of the accused at the earliest. It will be open to the Court to summon the concerned Police officials also if the Court is of the opinion that appropriate serious steps are not been taken by the Police officials. 7. With the aforesaid observation, this criminal writ petition stands disposed of. (ANANDA SEN, J.) Sandeep.Cp-3
