This bail application has been filed by the petitioner namely, Jahirul Islam Barbhuiya under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), Page No.# 2/3 2023, seeking regular bail in connection with Kachudaram P.S. Case No. 39/2025 under Sections 319(2)/316(2)/336(2)/ 125/271 of BNS, 2023. 3. Case diary is received and perused. 4. The allegation against the petitioner is that he has been practicing medicine on the basis of a degree, which is not recognized as one which should permit the holder thereof to practice medicine. 5. The petitioner was arrested on 19.09.2025 and by now he has been 35 days in custody and the charge-sheet in the case has also been filed and therefore, the investigation is also over. A similarly situated accused was granted bail by this Court in Bail Appln. No.1799/2025 vide order dated 02.06.2025 at the pre charge-sheet stage. 6. Having regard to the above as well as the nature of the allegations, the prayer for bail is allowed. 7. Accordingly, the petitioner, named above, shall be released on bail on furnishing a bond of Rs.25,000/- (Rupees Twenty Five Thousand) with one surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Cachar, Silchar in connection with the aforementioned case. 8. The petitioner shall not practice medicine on the basis of the degree, which is not recognized as one which should permit the holder thereof to practice medicine. Page No.# 3/3 9.
